Board of County Commissioners Meeting Recap: June 22, 2023

BOCC Action for June 22, 2023

Lease amendment for Gardner Multi Service Center 

Executed a lease amendment with Buckley Properties, a Limited Liability Company, to extend the term five years for the Gardner Multi Service Center at 510 W Main, Gardner, for an amount of $39,600 per year. Vote: Passed 7-0.

Rezoning and plats for Steele Waters 

Approved a request from Matt Cox of AllenbrandDrews, applicant, on behalf of Thomas and Shawnna Steele and Clifton and Jacqueline Bencke, landowners, for a Rezoning from PRU1B and RUR to PRU1B, Preliminary and Final Plat, which shall serve as the Preliminary and Final Development Plans, seven plat exceptions, and one minimum infrastructure waiver for a three-lot residential lot to be known as Steele Waters, located at 15236, 15240 and 15250 Lake Road 12 Street, Gardner Township. 

Resolution No. 043-23 and plat exception authorization. Vote: Passed 7-0.

Final plat for Mulberry Hill Estates 

Approved a request from Jay O’Dell, Aubry Enterprises, applicant, and Dale Klaasmeyer, Klaasmeyer, LLC, landowner, for a Final Plat for 12 residential lots to be known as Mulberry Hill Estates, Second Plat, on approximately 27-acres, on property zoned RN-2, Residential Neighborhood Two District, located on the northeast corner of Gardner Road and 151st Street. Vote: Passed 7-0.

Plats for Schweizer Cove 

Approved a request from Chris Eakin with Eakin Co, applicant, and Wayne and Cheryl Schweizer, landowner, for a Preliminary Plat and Final Plat, which shall serve as the Preliminary and Final Development Plans, and a Minimum Infrastructure Waiver to not construct 152nd Street to a Type “B” Collector Street Standard, for one residential lot, to be known as Schweizer Cove, on a 20,800-square-foot lot zoned PRU-1B, Planned Residential Urban Single Family 1B District, located at 29235 W. 152nd Street, Gardner Township. Vote: Passed 7-0.

Plan for Building B2 at New Century Commerce Center 

Approved Resolution No. 044-23 and Application No. SW-23-291-FDP regarding a request from VanTrust Real Estate Development, LLC, applicant, and Johnson County, landowner, for a Final Development Plan for Building B2, for the New Century Commerce Center, on 18.66 acres, zoned PEC-LP, Logistics Park District, located in the vicinity of 165th Street and Clare Road. Vote: Passed 7-0.

Amendments to Rural Comprehensive Plan 

Adopted Resolution No. 048-23 to amend the Johnson County Rural Comprehensive Plan, relating to future land use updates and changes regarding the Policy Area Map and the County’s Area Plans, including the 1998 Sunflower Army Ammunition Plant Concept Plan.  

Motion to amend revised comprehensive plan’s land uses for low density residential with a minimum of 10 acres per dwelling unit to 2 acres per dwelling unit. Vote: Failed 2-5.

Purchase of property for wet weather storage site 

After a public hearing, authorized funding in the amount of $313,825 and authorized the Chairman to execute the proposed “Real Estate Sale Contract” for the purchase of property within the City of Merriam for future use as a Johnson County Wastewater wet weather storage site and any other documents required for the authorized purchase. Vote: Passed 7-0.

Easements for proposed pump station 

Executed an “Easement Purchase Agreement” in the amount of $309,020 for the acquisition of easements within the City of Leawood for a proposed pump station as part of the State Line Road Pump Stations and Force Main Project. Vote: Passed 7-0.

Installation of fiber optic lines 

Authorized the Wastewater General Manager to execute an agreement with K&W Underground, Inc. to install fiber optic lines through the Nelson Wastewater Treatment Facility, in an amount not to exceed $175,000, per the City of Olathe Agreement No. 21-0102. Vote: Passed 7-0.

Contract for paving project at Sunset Office Building 

Authorized a contract with Phillips Site Work, Inc. for the Sunset Paving Repairs and Replacement – Phase 1 Project at the Sunset Drive Office Building, 11811 S. Sunset Dr., Olathe, in the amount of $142,307.15. Vote: Passed 7-0.

Contract for paving project at Northeast Office 

Authorized a contract with R&R Concrete, Inc. for the Northeast Office Paving Repairs and Replacement – Phase 1 Project located at 6000 Lamar Ave., Mission, in the amount not to exceed $524,580. Vote: Passed 7-0.

Revised policy on equal job opportunity 

Adopted revised Human Resource Policy 105 pertaining to equal opportunity in employment to be effective June 22, 2023. Vote: Passed 7-0.

Adoption of policies about certain employee benefits 

Adopted revised Human Resource Policies 503, 504, 505, and 508 pertaining to certain employee benefits to be effective June 22, 2023. Vote: Passed 7-0.

Purchase of commercial property 

After executive session and reconvening in public session, motion was made for Chairman to execute a broker agreement between the BOCC and Highlands Real Estate for the purchase of a commercial property. Vote: Passed 5-2.

Sale of Lease Purchase Revenue Bonds on Aug. 9 

Approve and adopt Resolution No. PBC 002-23 authorizing the sale of approximately $17,095,000 principal amount of Lease Purchase Revenue Bonds, Series 2023A and approximately $7,000,000 principal amount of Lease Purchase Revenue Bonds, Series 2023B of the Public Building Commission of Johnson County, Kansas on Aug. 9, 2023. 

Committee of the Whole on June 22, 2023

Today the Board met as a Committee of the Whole to receive a FY 2024 budget presentation and discussion in finalizing proposed budget for legal publication. Authorization to publish the proposed FY 2024 budget is on the board’s action agenda for June 29, 2023. 

The Board received a report on Johnson County Opioid Settlements Funds.  

Motion was made to direct staff to bring forward for future action on use of $200,000 from opioid settlement funds. Vote: Passed 5-1.

Items on the Agenda for June 29, 2023

Modifying 2023 Johnson County Pay Table 

Resolution No. 055-23. Consider approving and adopting Resolution No. 055-23 modifying the Fiscal Year (FY) 2023 Budget Resolution No. 064-22 and approving a modified 2023 Johnson County Pay Table representing an average change of 6.1%; approve a market pay adjustment for all eligible employees under the Pay Table to align with market and comply with the county’s pay philosophy as approved by the Board of County Commissioners; and authorize the reallocation and expenditure of FY 2023 reserves in the amount not to exceed $7,649,129 as shown in Attachment I.  

Modifying 2023 Emergency Services Pay Table 

Resolution No. 056-23. Consider approving and adopting Resolution No. 056-23 modifying Resolution No. 029-23 and approving a modified 2023 Emergency Services Pay Table and approve a 2% range movement adjustment for all eligible employees under the ES Pay Table that were originally approved as part of the FY 2023 Budget Resolution; and authorize the reallocation and expenditure of FY 2023 General Fund reserves in an amount not to exceed $162,721.  

Publication of proposed FY 2024 budget  

Consider authorizing the publication of a proposed budget for Johnson County Government in the amount of $x,xxx,xxx,xxx for fiscal year 2024, notifying the county clerk of the proposed intent to exceed the revenue neutral rate, and setting a public hearing on the proposed budget at 6 p.m. Monday, Aug. 21, in the Board Chambers.  

Publication of proposed FY 2024 for Fire District No. 2 

(Sitting as the Fire District No. 2 Governing Board) Consider authorizing the publication of a proposed budget for Johnson County Fire District No. 2 in the amount of $x,xxx,xxx for fiscal year 2024, notifying the county clerk of the proposed intent to exceed the revenue neutral rate, and setting a public hearing on the proposed budget at 9:30 a.m. Thursday, Aug. 24, in the Board Chambers.  

Sale of bonds for airport improvements 

Resolution No. 051-23. Approve and adopt Resolution No. 051-23 authorizing the sale of approximately $16,840,000 principal amount of General Obligation Internal Improvement Bonds of Johnson County, Kansas on Aug. 9, 2023 for airport improvements.  

Opt-in for DROP in retirement benefits 

Resolution No. 052-23. Consider authorizing Johnson County Government to opt-in to the Deferred Retirement Option Program (DROP), administered by the Kansas Public Employees Retirement System, allowing Kansas Police & Fire members to initiate the calculation of retirement benefits, but continue working for three to five years (the DROP period) before separating from employment.  

Funding for wastewater construction project 

Resolution No. WD 23-017. Conduct a public hearing and consider authorizing funds in an amount not to exceed $1,631,600, increasing the total authorization to $1,812,600, for the construction phase of the Brush Creek Sanitary Sewer Relocation and Capacity Upgrade Project and consider entering into an agreement with the City of Prairie Village for Johnson County Wastewater to reimburse the city for the work.  

Contract expenditure authority for architectural services 

Consider authorizing an increase in contract expenditure authority for countywide term and supply contracts with bcDesign Group, Dake Wells Architecture, Finkle + Williams Architecture, SFS Architecture and The Clark Enersen Partners for On Call Architectural Services, in an amount not to exceed $1,500,000 for a total contract expenditure authority of $3,000,000 for the current contract term, Nov. 22, 2022 to Nov. 21, 2023, with an additional one year renewal option at the original authorization of $1,500,000 annually.  

Funding for Sunflower Fire Station Project 

Consider authorizing an increase of $1,500,000 to the Sunflower Fire Station Project bringing the new total project authorization to an amount not to exceed $2,000,000 from a reallocation of General Fund reserves (Countywide Support Funds) in the amount of $1,500,000 to fund the design phase of the fire station project, to be located near the intersection of Lexington Avenue and 102nd Street, at the former Sunflower Army Ammunition Plant and to approve a contract with SFS Architecture for design services for a total amount not to exceed $1,543,000, utilizing the Architectural Term and Supply Contract, RFP 2019-078.  

Creation of Sustainability Coalition 

Resolution No. 053-23. Consider the creation of the Sustainability Coalition for the purpose of encouraging environmental stewardship across the Johnson County community and advise the Board of County Commissioners on sustainability policy options.  

Creation of Diversity, Equity and Inclusion Coalition 

Resolution No. 054-23. Consider the creation of the Diversity, Equity and Inclusion Coalition to foster an inclusive community where all people are connected, safe and have a sense of belonging, and to cultivate a welcoming, diverse community where all people are valued.
