BOCC Action for April 6, 2023

Possible scheduling lunch breaks in Board meetings 

Approved a motion to place on a future action agenda to revise the Amended Rules of Order to add under Article IV regarding designated lunch breaks for the Board in future meetings. Vote: Passed 4-3.

Reappointment of Brian Roby 

Approved the reappointment of Brian L. Roby - Second District representative to the Housing and Community Development Advisory Committee through March 31, 2026. Vote: Passed 7-0.

Reappointment of Jonathan Birkel 

Approved the reappointment of Jonathan Birkel - Seventh District representative to the Transportation Council through Dec. 11, 2024. Vote: Passed 7-0.

Appointment of Scott Sayers 

 Ratified the appointment of Scott Sayers – Chairman representative to the Transportation Council through Sept. 1, 2025. Vote: Passed 7-0.

Contract increase for toxicology services 

Approved Request for Proposal (RFP) 2020-033 and authorized a contract increase in the amount of $50,000 with AXIS Forensic Toxicology and NMS Labs, for toxicology reference services, in the total amount of $150,000 for contract renewal two, March 11, 2023 to March 10, 2024, with two remaining one-year renewals. Vote: Passed 7-0.

Modified pay table for Emergency Services 

Adopted Resolution No. 029-23 modifying the Fiscal Year (FY) 2023 Budget Resolution No. 064-22 and approved a modified 2023 Emergency Services Pay Table to include training captains within the ES Pay Table originally approved as part of the FY 2023 Budget Resolution. Vote: Passed 7-0.  

Pay adjustments for select targeted positions  

Approved and authorized pay adjustments to address market equity and alignment for select targeted positions, specifically correctional officers, correctional supervisors, case management supervisors and support providers; approved and authorized the reclassification and use of General Fund reserves in an amount not to exceed $540,000 for Corrections and District Attorney’s Office; and the reclassification and use of Developmental Supports Fund reserves in an amount not to exceed $945,000; and the reclassification and use of Mental Health Fund reserves in an amount not to exceed $191,250, effective April 30, 2023. Vote: Passed 7-0.

Agreement for meal preparation and delivery 

Authorized an exception to competition and services agreement with Hy-Vee, Inc. to provide meal preparation and delivery for the Adolescent Center for Treatment, the Crisis Recover Center and Adult Detox Unit in an amount not to exceed $225,000 annually for a period of one year with the option to renew for four additional one-year periods per Administrative Policy and Procedure #110.180.A.16. Vote: Passed 7-0.

Designation of official newspaper  

Approved Resolution No. 026-23 to designate The Legal Record as the official newspaper and authorized an exception to competition with The Legal Record for the purchase of legal publications, in the amount not to exceed $150,000 for a one-year term with four optional one-year terms. Vote: Passed 7-0.

Appointment of Haile Sims 

(Added item to agenda) Approved the appointment of Haile Sims - Seventh District representative to the Tenth Judicial District Nominating Commission through March 7, 2027. Vote: Passed 7-0.

Interim funding for Olathe Med-Act project 

Authorized the execution of a cooperation agreement between Johnson County and the Public Building Commission to transfer and advance up to $9,892,008 from County General Fund reserves to provide interim funding for the Med-Act Olathe Facility capital project. Vote: Passed 7-0.

Special Meeting as the Public Building Commission on April 6, 2023

Med-Act facility in Olathe 

Approved Resolution No. PBC 001-23 to acquire, design, construct, reconstruct, equip and furnish improvements to a Med-Act facility to be located in Olathe; authorized the execution of a cooperation agreement between Johnson County and the PBC; and authorized the issuance of revenue bonds in an amount not to exceed $9,892,008 plus the cost of issuance for the purpose of paying all or a portion of the costs thereof and related financing costs; and provided for the giving of notice of said intention. Vote: Passed 7-0.

Elevator project at Administration Building 

Approved IFB # 2022-081 and authorized a contract with Henderson Companies Inc dba Henderson Building Solutions LLC for the Administration Building Elevator Modernization Project located at 111 S. Cherry Street, Olathe, in the amount of $779,760. Vote: Passed 7-0.

Dust Control Cost Share Program gets underway 

The Dust Control Cost Share Program is returning for its fourth year, and the Public Works Department is expecting an increase in applications again this year. In 2020, 46 applications were received, 97 applications in 2021 and 114 applications in 2022. At the conclusion of the 2020 program, a survey was sent to participants and results showed 75% overall satisfaction with the program. This year, the residents’ 50% cost share for the 400-foot minimum of dust control is $322. The cost of additional coverage will be paid at 100% by the resident ($1.61 per foot). Applications are being accepted until May 5. The tentative schedule for applying the dust control is the first week of June. The application form and program information are available on the Public Works website.  

Board receives Program Major Projects Report  

The County Manager provided a report for major projects over $1 million and master plans. The update  is provided bimonthly and supplements the Public Building Commission bi-annual reports in February and August. The report provided major project information through March 31, 2023.

The final Housing Subcommittee Report, including next steps, was presented by Commissioner Hanzlick, a member of the subcommittee. The subcommittee also included Commissioners Allenbrand and Fast. View the report

Consider approving the disposition of two covered Croft trailers by donation from the Department of Emergency Services to Johnson County Fire District #1 and the Olathe Fire Department, for continued use as Community Emergency Response Teams assets pursuant to Administrative Surplus Property Policy #210.140, subparagraph F.1.

Resolution No. 025-23, City of Gardner application, approving a Site Plan for New Trails Convenience Store and Gas Station, located on the southwest corner of 175th Street and New Trails Parkway, Gardner, and located within one mile of the New Century AirCenter.

Resolution No. 022-23. Consider City of Gardner Application No’s. FDP-22-08 and FP22-12 a Final Development Plan, and Final Plat for Tallgrass Apartments Phase 3, containing 5 apartment buildings with 80 dwelling units on 6.06 acres, located north of 167th Street and east of White Drive, within one  mile of New Century AirCenter.

Resolution No. 019-23. Consider City of Olathe Application No’s. PP22-0002, PR22- 0035, PAR22-0081, and FP23-001, a Revised Preliminary Development Plan, Revised Preliminary Plat, Final Development Plan, and Final Plat for the proposed development of Project Acura – Heartland Coca-Cola Bottling Facility on 116.9 acres, located south of 167th Street and west of Hedge Lane, within one mile of New Century AirCenter.  

Purchase of extraction robots for Crime Lab 

Consider authorizing an exception to competition with Promega Corporation., for the purchase of three (3) Maxwell® RSC 48 extraction robots and supplies by the Sheriff’s Office Crime Lab, in an amount of $146,280.60.  

Pre-design contract for a new Health Services Building 

Request for Proposal (RFP) 2022-049, Consider authorizing a contract with Finkle + Williams Architecture, for Phase One Pre-Design Services for a new Health Services Building, in an amount not to exceed $340,000.
