BOCC Agenda for Dec. 5, 2024

Continuation of CUP renewal for outdoor storage yard

Approved continuation until Jan. 9, 2025 a request from Phelps Engineering, Inc, applicant, and Bryant and Sheri Combes, landowners, for renewal of a conditional use permit to allow an outdoor storage yard in association with a construction contractor office and shop, on 6.93 acres, on property zoned PEC-3, Planned Light Industrial Park District, located at 6946 W. 207th St., in Section 8, Township 15, Range 25. Vote: Passed 6-0.

Appraiser’s retirement, creation of screening committee

Accepted the retirement letter of County Appraiser Beau Boisvert, effective Jan. 24, 2025; created of an Appraiser Screening Committee comprised of Chairman Kelly, Commissioner Fast, Commissioner Hanzlick, Commissioner Allenbrand and Commissioner Ashcraft, to bring finalists for the appraiser position to the full BOCC for consideration; approved Resolution No. 096-24 naming Deputy County Appraiser Kara Endicott as the interim county appraiser; and delegated the selection of a search firm to staff. Vote: Passed 6-0.

2025 Audit Plan by interim county auditor

Approved the 2025 Audit Plan proposed by the interim county auditor. Vote: Passed 6-0.

Additional state grant funding and 1.57 FTE

Approved the acceptance of an additional $198,448 in public health state formula funding from the State of Kansas, bringing the total award to $1,135,121, and approved the addition of 1.57 FTE, which will be fully funded by the additional grant funds. Vote: Passed 6-0.

Dissolving Johnson County Food Policy Council

Approved Resolution No. 092-24, a resolution dissolving the Johnson County Food Policy Council. Vote: Passed 6-0.

Reorganizing the Commission on Aging

Adopted Resolution No. 091-24 to reorganize the Commission on Aging, and amend and approve bylaws for the COA. Vote: Passed 6-0.

Grant to expand Adult Treatment Court

Accepted the Bureau of Justice Assistance Grant from the United States Department of Justice in the amount of $1 million to expand services for the Johnson County Adult Treatment Court and authorize the reallocation and expenditure of Mental Health’s fund balance (reserves) for FY 2025 in the amount of $200,000. Vote: Passed 6-0.

Contract for boiler replacement project

Authorized a contract with BCI Mechanical, Inc. for the boiler replacement project at the Sunset Drive Office Building in the amount of $216,844. Vote: Passed 6-0.

Property and liability insurance policies for 2025

Approved the placement and/or renewal of the property and liability insurance policies for calendar year 2025 with the quoting carriers in an amount not to exceed $2,798,282. Vote: Passed 6-0.

Additional land record technology projects for 2025

Authorized additional land record technology projects for fiscal year 2025 for the Department of Technology and Innovation and transferring and appropriating excess Register of Deeds technology funds from fiscal year 2024 in the amount of $210,648 for these projects. Vote: Passed 6-0.

Printing and mailing of 2025 real property tax statements

Authorized additional land record technology projects for fiscal year 2025 for the printing and mailing of real property tax statements and transferring and appropriating excess County Clerk technology funds from fiscal year 2024 for the new projects in the amount of $40,000. Vote: Passed 6-0.

Increased contract authority for transit service costs

Authorized an increase to the contract authority with TransDev, dba First Transit, Inc., of $4,506,459 for transit service costs in 2024. Vote: Passed 4-1-1.

Additional FTE and funding for DTI

Authorized the Department of Technology and Innovation to accept the Fiscal Year 2022 State and Local Cybersecurity Grant Program Award; approve the addition of one FTE; authorize the reallocation and expenditure of General Fund reserves in an amount not to exceed $187,185; and authorize the reallocation and expenditure of Wastewater O&M reserves in an amount not to exceed $112,418. Vote: Passed 5-1.

Election commissioner receives Liberty Bell Award

Johnson County Election Commissioner Fred Sherman has been selected by the Johnson County Bar Association to receive the Liberty Bell Award. Founded in 1938, JoCo Bar is a professional organization with more than 1,300 members, including judges, attorneys and legal professionals in supporting roles. The association is dedicated to advancing the legal profession through education, member services and community initiatives. The Liberty Bell Award honors non-lawyers who demonstrate exceptional service in promoting a deeper understanding of the Constitution and Bill of Rights, fostering respect for law and the courts, encouraging civic responsibility, supporting the effective functioning of government or enhancing awareness of the rule of law. Sherman was recognized for his contributions at the bar association's annual luncheon on Wednesday, Dec. 4 .

Report provides update to major projects

This report for major projects over $1 million and master plans is provided bimonthly and supplements the Public Building Commission's biannual reports in February and August. The information contained in this report is through Nov. 27, 2024.

Other Reports

Sitting as Governing Board of Fire District No.2, the board received 2023 Financial Audit Reports of the fire district.

The Board was also presented the Johnson County’s 2023 Single Audit Report.

Committee of the Whole Agenda for Dec. 5, 2024

Update on Transit Strategic Planning

The Board met as a Committee of the Whole to receive a Transit Strategic Planning Update.

Motion was made to direct staff to continue development of a plan using Scenario B to increase frequency of transit services along with increased coverage by more routes to new places and bring back to the Board in a study session or COW. Vote: Passed 5-1.

Resolution No. 094-24. Consider approving Resolution No. 094-24 authorizing the cancellation of outstanding county-issued checks that are at least two years old.

Amended consent order regarding wastewater’s integrated plan

Resolution No. WD 24-036. Consider directing the Wastewater General Manager to enter into an amended consent order with the State of Kansas Department of Health and Environment (KDHE) related to Johnson County Wastewater’s Phase 2 Integrated Plan.

Revision to 2025 CARS expenditures

Consider authorizing a revision to 2025 County Assistance Road System Program expenditures, by replacing the Midland Drive, I-435 to Shawnee Mission Parkway project with Shawnee Mission Parkway, I-435 to K-7 project, at no additional cost to the county.

Contract extension with UMB Bank

Consider authorizing a contract authority increase with UMB Bank, N.A. in the amount of $80,000, for a total contract authority of $220,000 through Dec. 31, 2024 and a contract extension in the amount not to exceed $120,000 through June 30, 2025, per RFP 2016-027.

Reorganizing compliance structure of protected health information

Resolution No. 065-24. Consider adopting Resolution No. 065-24, which repeals Resolution No. 011-03 and reorganizes the county’s compliance structure for the confidentiality and security of protected health information to ensure compliance with federal healthcare laws.

Reorganizing compliance structure under ADA

 Resolution No. 095-24. Consider adopting Resolution No. 095-24, reorganizing the Johnson County’s Compliance Structure under the Americans with Disabilities Act, and to Repeal Resolution No. 120-92.

Contract for purchase of transit buses

Consider authorizing a contract with Gillig LLC, for the purchase of eight wheelchair accessible low-floor 29-foot clean diesel transit buses, including the requisite ancillary equipment, with $4,287,523 of Federal Section 5339 Bus and Bus Facilities funding and a county match of $756,621 from the Transit Vehicle Replacement set-aside project for a total cost not to exceed $5,044,144, per State of Washington Contract RFP #06719-01.

Contract renewal for transit services

Consider authorizing a two (2) year contract renewal with TransDev, doing business as First Transit, WHC Worldwide and EcoLane for transit services and scheduling, at a total cost not to exceed $26,586,597 with a contract term of Jan. 1, 2025 to Dec. 31, 2026 per RFP F20-7024-30A and RFP F21-7037-30A with the option to renew one 2-year period and assign the agreement with First Transit to TransDev per the acquisition on March 7, 2023.

Joint funding agreement for stream health assessment

Consider approving a 3-year joint funding agreement with United States Geological Survey for a stream health assessment in Johnson County, in an amount not to exceed $314,550.

Reallocation and expenditure of reserves

Consider authorizing the reallocation and expenditure of fund balance (reserves) for Fiscal Year (FY) 2024 for the following funds: General Fund in an amount not to exceed $2.5 million; the Developmental Supports Fund in an amount not to exceed $1.4 million; and the Park and Recreation Employee Benefits Fund in an amount not to exceed $1.4 million.

Salaries of Chairman and members of the BOCC

Resolution No. 093-24. Consider approving and adopting Resolution No. 093-24 modifying certain provisions of the Fiscal Year (FY) 2025 Budget Resolution No. 056-24 related to salaries for the positions of Board Chairman and County Commissioner and adopting procedures for annual consideration of Board Chairman and County Commissioner salaries.
