Trucks in Unincorporated Johnson County

Trucks are a vital part of the economy as they are needed to deliver goods and services. Federal and State statutes allow legally sized trucks full access to the road network like any other vehicle.  

The map below shows the current no-truck routes in the unincorporated portion of the County.  There are currently three no-truck routes posted due to safety related issues and the other postings are due to other jurisdictional no-truck postings.

The resolutions passed by the Board of County Commissioners for current no-truck routes have the exemptions noted below:

  1. Vehicles operated by any fire, police, ambulance service, or other vehicle operated by a governmental entity. 
  2. Implements of agriculture or husbandry.
  3. Vehicles used in connection with the construction, repair, or maintenance of a public or private utility service on property located along or reasonably accessible only from the designated roadway.
  4. Vehicles engaged construction, repair, or maintenance of roadways by or under the direction of any governmental entity.
  5. Vehicles delivering construction materials for a construction project authorized and permitted by any governmental entity located along or reasonably accessible only from designated roadway, but only during normal construction hours for the duration of the project and subject to scheduling, when necessary, by authorized building inspectors.
  6. Vehicles making deliveries to or picking up packages from residences along the designated roadway.
  7. Vehicles operated in connection with the residential uses of property located along or reasonably accessible only from the designated roadways.
  8. A business that operates trucks with an origin or destination on a road designated for no trucks is exempted from this resolution provided that no reasonable alternate route is available.

Enforcement and Penalty for No-Truck Violation

The Johnson County Board of County Commissioner's passed resolutions that say “It shall be unlawful to use or to operate any commercial vehicle or any combination of vehicles with a gross vehicle weight rating (GVWR) or gross combination weight rating (GCWR) of sixteen thousand (16,000) pounds or greater.  Any person, firm, or corporation that violates the provisions of this resolution is guilty of a public offense of violating a County Resolution as provided by K.S.A. 19-101d, and upon conviction for such violation shall be fined an amount of two hundred Dollars ($200.00) for each separate offense.”

Appropriate traffic control signs have been posted along and at the entrance to each of the designated streets and roadways as notice that use by any commercial vehicles or any combination of vehicles with a gross vehicle weight rating (GVWR) or gross combination weight rating (GCWR) of sixteen thousand (16,000) pounds or greater is prohibited.

Written Special Permit

A written special permit may be issued by the County Engineer authorizing, for good cause shown, the temporary operation of a commercial vehicle or any combination of vehicles with a gross vehicle weight rating (GVWR) or gross combination weight rating (GCWR) of sixteen thousand (16,000) pounds or greater upon roadways designated as a no-truck route. Such permit shall be obtained through an application on forms prepared by the County Engineer. The County Engineer is authorized to issue or withhold any special permit at the County Engineer’s discretion and, if such permit is issued, to limit the number of trips, and establish seasonal or other time limitations within which the permitted vehicle may be operated upon the roadway designated in the permit. The County engineer may impose other reasonable limitations or impose conditions upon the applicant when necessary to protect the public welfare or assure against damage to the roadway. Every permit issued by the County Engineer shall be carried in the vehicle to which it refers and shall be displayed, upon request, to any law enforcement officer or any authorized agent of Johnson County. The County Engineer may establish a fee for each permit issued pursuant to this resolution, such fee not to exceed $25.00; provided, however, that no fee shall be charged to the state of Kansas, and city, county, or other political subdivision of the state. The issuance of a special permit shall not release the permittee or vehicle operator from liability for damage to the roadway cause by the permittee’s or vehicle operator’s use of the designated street or roadway.
